Zen Dermatology Recurring Dues Membership Agreement
Our membership program offers you exclusive pricing on products and services that are offered at Zen Dermatology. It works by banking money on a monthly basis. Every penny you spend on membership will be applied to your account each month.
The Terms of Membership below contain very important information regarding your rights and obligations, as well as conditions, limitations and exclusions that might apply to you. Please read it carefully.
The Terms of Membership require the use of arbitration on an individual basis to resolve disputes, rather than jury trials or class actions.
Membership and Recurring Payments
By selecting Zen Dermatology’s ZD membership plan, you consent to these Terms and authorize Zen Dermatology to charge the credit card or debit the debit card account you have specified on this form, in the amount of $199 each month. You agree that the payment card specified by you for automatic monthly payments to Zen Dermatology is, and will continue to be, an account that you own, and that you will maintain sufficient availability under your card limit, or sufficient funds in the account linked to your debit card, as applicable, to pay your monthly designated amount. The automatic charge to your credit card or debit to your debit card account will occur on approximately the same due date each time, but may vary if, e.g., your prior payment has not successfully settled or if your membership began on a day not contained in a given month.
Consent to Recurring Payments
You acknowledge and agree that by accepting the above recurring payment terms and conditions (“Recurring Payment Terms”), you consent to receive a copy of your payment authorization for recurring monthly payments to Zen Dermatology in electronic form only instead of receiving a paper copy. This consent applies only to recurring payment authorizations as to which Zen Dermatology is required to provide you with a written copy under applicable law. Zen Dermatology cannot process your online recurring payment authorization unless you are willing to receive, in electronic form only, any copy of the Recurring Payment Terms that we are required to provide to you in writing under applicable law. Consequently, once you have accepted the Recurring Payment Terms, you cannot withdraw your consent to receive your copy of the Recurring Payment Terms in electronic form. However, you will still be able to cancel your recurring payment authorization in accordance with the terms below. If you wish to obtain a paper copy of your recurring payment authorization, you may do so by printing the Recurring Payment Terms yourself.
Changes to the Price and Membership Plans
We reserve the right to change our membership plan or adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms, any price changes or changes to your membership plan will take effect following notice to you.
Updating your Payment Methods
You can update your payment method by calling our clinic or coming in to fill out a new form. Following any update, you authorize us to continue to charge the applicable payment method(s).
Continued Obligation
If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to Zen Dermatology membership discounts on services and products until we have successfully charged a valid payment method. For some payment methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your payment. Check with your service provider for details.
Canceling Your Membership
Your membership to Zen Dermatology will continue for a minimum of 12 months and will automatically renew until terminated. You can cancel your membership and recurring payment authorization only by contacting Zen Dermatology by email at info@zendermatology, by hand delivering written notice to the clinic, or by sending written notice via certified mail to Zen Dermatology, 4801 J St., Sacramento, CA 95819. Your request to cancel your recurring payment authorization must be received by Zen Dermatology at least thirty business days prior to the next payment date. If your cancellation request is submitted after this time, the cancellation may not take effect until the following billing cycle. If you decide to cancel your membership, you will continue to have access to all funds that you have deposited. If you choose to cancel before the initial 12-month period, you will be charged a $299 early termination fee.
No Refunds or Substitutions
Payments are nonrefundable and there are no refunds or credits for unused or partially used complimentary services offered through the membership. Following any cancellation, you will continue to have access to all deposited funds for an unlimited amount of time. There will be no substitutions on complimentary services. If you choose not to take advantage of the complimentary services, they will not rollover and there will be no credit issued on your account for those services.
We have the right to, at any time and at our sole discretion, reject the payment method selected by you. If no effective payment method is in place, your access to membership may be suspended; access will only be restored upon full settlement of all charges and putting in place an accepted payment method.
Exclusions
Excluded services include: Consultation (cosmetic, derm, hormone, skin) fees, HRT visits, biopsies, gift cards, laboratory services, testing services, Pronox, Prolon kits, and any product or service that is not sold directly at Zen Dermatology.
Membership Benefits and Payment Method
I understand that the benefits available to me through my membership are non-transferable and do not carry over from week to week, month to month, or year to year. The benefits available include:
- 1 complimentary level 2 peel, facial, or Platinum HydraFacial per year
- 1 IM, sauna, or red light session per week
- 5% off products, services, and holistic visits
- 50¢ off per unit of Botox or Xeomin, or 20¢ off per unit of Dysport
I hereby authorize Zen Dermatology to charge my account $199 each month.
By signing this document, I affirm that I am of legal age to enter into this agreement, and that I have read, fully understand, accept and are bound by the Terms of Membership at Zen Dermatology.
